Failure to warn residents of dangers posed by talc mine

Anna Bishop lived in St. Lawrence County, N.Y., and, from 1964 to 1984, resided less than a mile from a Vanderbilt Minerals talc mine. She was diagnosed as having mesothelioma, underwent surgery to remove fluid from around her lungs, and died of her condition three months later at age 78.

Bishop’s representative sued Vanderbilt Minerals, LLC, alleging it failed to warn residents of the dangers posed by the mining operation and asbestos exposure through the air. The defendant had engaged in a pattern of indifference for the safety of its operations, the plaintiff claimed.

The jury awarded $12.25 million.
