Failure to diagnose breast cancer
March/April 2021After undergoing treatment for breast cancer in her right breast, Jacquelyn Laumakis underwent regular mammograms and radiology studies, interpreted by Radiology Affiliates Imaging and radiologist Daniel Cohen. After one such mammogram, in 2015, Cohen allegedly reported that Laumakis had no significant changes in her right breast. The physician, who did not dictate an interpretation of the left breast, recommended a 12-month follow-up. Less than a year later, Laumakis felt a lump in her left breast. A subsequent mammogram, interpreted by Cohen, revealed two masses in the left breast. Laumakis was diagnosed as having metastatic breast cancer, which led to her death at age 66.
Laumakis’s estate sued Cohen, Radiology Affiliates, and the hospital where she had her mammogram, alleging failure to diagnose breast cancer present in the left breast in 2015. The plaintiff asserted that the defendants should have referred Laumakis for an ultrasound and biopsy in 2015 in order to rule out breast cancer.
The parties reached a partial settlement in the case for an undisclosed amount.
