Failure to warn of dangerous condition at newly constructed home
December 23, 2024Barbara Williams noticed that a metal shelving unit in the master bedroom closet of her newly constructed home had fallen to the floor. Suncoast Insulators & Specialties, which was hired by general contractor ICI of Gainesville Residential, LLC, reinstalled the shelving unit. A few days later, Williams was in the closet on a stepladder when the unit detached from the wall, striking her and knocking her to the ground. She suffered injuries and required treatment. Her medical expenses were more than $76,000.
Williams sued ICI of Gainesville Residential, LLC, alleging it failed to ensure the shelving unit was properly installed and failed to warn of a dangerous condition, among other things.
The jury awarded approximately $997,400.
