Inadequate toileting assistance

Patricia Pope fell while an aide was assisting her to the commode at the Victoria Manor Personal Care Home. She suffered bilateral femur fractures, as well as bruises and contusions. She underwent surgery and suffered significant pain.

Pope sued the facility’s owner and operator, among others, alleging failure to provide adequate fall prevention and toileting assistance.

The court awarded more than $1 million.
