Breach of contract, bad faith

January/February 2025

Family Security Insurance Co. provided a homeowners’ insurance policy for the property of Sigmund Swenson and Thor Swenson. After the property was damaged in Hurricane Ida, Sigmund filed a timely insurance claim for property damage. Family Security failed to pay the requested amounts for repairs and replacement items.

The Swensons sued the insurer, alleging breach of contract and bad faith. The plaintiffs asserted that the defendant had failed to thoroughly investigate the claim and failed to pay it despite obvious damage. Additionally, suit claimed the defendant had breached its affirmative duty to make a reasonable effort to settle the claim.

The court awarded over $150,000.
