Failure to respond to change in patient’s condition
January/February 2025James Rigler, 55, was admitted to Statesman Health and Rehabilitation Center for 24-hour nursing and rehabilitation services. At the time of his admission, Rigler suffered from obesity, weakness, diabetes, and other problems. Because he experienced genitourinary problems, he was provided a Foley catheter. This caused complications, including a blockage.
Rigler’s condition deteriorated, and he was taken to a hospital, where he died of septic shock.
Suit against the facility and others alleged failure to monitor Rigler’s condition, respond to a change in his condition, develop a comprehensive care plan, and notify his physician after he experienced a significant change in condition. Additionally, the plaintiff alleged violation of resident rights.
The parties settled for $355,000.
