Failure to timely diagnose kidney cancer

January/February 2025

Craig Beaubien was referred to hematologist Charu Trivedi to determine the cause of an abnormal blood test showing a high hematocrit level. Trivedi allegedly determined that kidney cancer was one of multiple possible causes for the hematocrit result but did not order any diagnostic testing to rule out kidney cancer. Approximately seven months later, Beaubien developed headaches. He underwent imaging, which revealed an 8.3-cm tumor in his kidney. The cancer had metastasized to his brain, necessitating radiation, chemotherapy, immunotherapy, and surgery. Despite this treatment, he died. He is survived by his wife.

She sued Trivedi, alleging professional negligence. The plaintiff argued that had Beaubien been diagnosed at an earlier stage, the cancer would not have metastasized to his brain.

The jury awarded over $8.6 million.
