Low-speed collision

Jeff Missey, 61, was stopped on an interstate highway when a tractor-trailer rear-ended him at 10 mph. He underwent conservative treatment for a herniated disk in his cervical spine before undergoing surgery to implant a cervical spine stimulator. Complications arose, however, and the stimulator was subsequently removed. Missey then underwent spinal fusion surgery, which has left him with permanent pain and limitations.

He sued Bob Cope Farms, LLC, alleging liability for the collision. Suit did not claim past medical expenses or lost income.

The defense disputed liability and argued that Missey’s treating providers were responsible for any continuing issues he experienced.

The parties agreed to a settlement for $3 million.
