Negligent discontinuation of continuous fetal monitoring
November 2024Doe was admitted to a hospital at 35 weeks gestation, suffering from an infection and diabetic ketoacidosis. She was placed on a continuous fetal heart rate monitor and treated for the infection. Nursing staff allegedly documented ongoing intermittent and recurring late decelerations over the course of several hours.
A maternal fetal medicine specialist allegedly ordered that the continuous fetal monitoring be stopped. Several hours later, a nurse was unable to find fetal heart tones, and it was confirmed that the baby had died.
Doe sued the specialist’s employer, alleging that the physician negligently discontinued fetal monitoring.
The parties settled for $750,000.
