Failure to control aggressive dogs

Quaneysha Poindexter was making a delivery on behalf of a Fed Ex contractor to the home of John Taubl. Two of Taubl’s dogs charged at Poindexter and began to bark excessively, causing her to trip and fall as she attempted to run away. She suffered a fractured foot, contusions, and nerve damage.

Poindexter sued Taubl, alleging negligence; common law recklessness; and violation of Conn. Gen. Stat. §22-357, which imposes liability on a dog owner for damages to a person’s body. The plaintiff asserted that the defendant had actual knowledge of the dogs’ propensity for aggression toward delivery people and that despite this, the dogs were allowed to roam free and unattended on the property.

The jury awarded over $144,500, including more than $13,900 in lost income.
